(3) When preparing the details in accordance with sub-sections (1) and (2), unless there is no other way to mention the characteristics of the goods, construction work or service in a way that is clearly understood, any specific brand, trademark, name, patent, design, type, origin Or the name of the producer cannot be mentioned. But in cases where it is not possible to mention a specific brand, trademark, name, patent, design, type, origin or the name of the manufacturer, the words "similar" can be mentioned.
(4) In the tender or pre-qualification document, when mentioning the basis or indication or terminology related to the description and technical or quality characteristics of goods or construction work or other services and testing (testing), marking, packaging, labeling or certificate of confirmation (conformity certificate), such goods or No description, basis, indication or wording shall be mentioned in such a way as to hinder the participation of qualified bidders in the procurement process or to limit the competition without justification.
